    Your JUDICIARY COMMITTEE, to whom has been referred

SENATE BILL 44

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

    1. On pages 1 through 5, strike Section 1 in its entirety.

    2. Renumber the succeeding sections accordingly.

    3. On page 5, line 24, strike "in which a minor is present" and insert in lieu thereof "when a child who is required to be restrained in a rear-facing child safety seat, a forward-facing child safety seat, a booster seat or a motor vehicle's safety belt pursuant to Paragraphs (1) through (4) of Subsection B of Section 66-7-369 NMSA 1978 is present in the vehicle, regardless of whether the windows of the motor vehicle are down".

    4. On page 7, lines 10 and 11, strike "in which no minor is present" and insert in lieu thereof "when a child who is required to be restrained in a rear-facing child safety seat, a forward-facing child safety seat, a booster seat or a motor vehicle's safety belt pursuant to Paragraphs (1) through (4) of Subsection B of Section 66-7-369 NMSA 1978 is not present in the vehicle, regardless of whether the windows of the motor vehicle are down".
