    Your CONSUMER AND PUBLIC AFFAIRS COMMITTEE, to whom has been referred

SENATE BILL 40, as amended

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. Strike Senate Public Affairs Committee Amendment 1.

     2. On page 2, line 8, after the period, insert:

     "The board shall promulgate rules for the implementation of the provisions of this paragraph, including development of a standardized consent form for licensed practitioners to receive and supply donated prescription drugs. A drug that may only be dispensed to a patient registered with the drug's manufacturer in accordance with federal food and drug administration requirements shall not be donated or supplied under the provisions of this section. No person shall be liable for the bad faith of another person.".,

and thence referred to the JUDICIARY COMMITTEE.
