    Your PUBLIC AFFAIRS COMMITTEE, to whom has been referred

SENATE BILL 12

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

    1. On page 2, line 3, after "adult" insert ", regardless of physical, behavioral or developmental disability,".

    2. On page 4, line 2, strike ", and shall follow" and strike line 3 in its entirety and insert in lieu thereof "pursuant to the procedures provided for in Chapter 40 NMSA 1978.".

    3. On page 6, line 3, before "submit" insert "appear in person and".

    4. On page 7, between lines 9 and 10, insert the following subsection:

         "D. The requirement in Subsection B of this section that the individuals appear in person shall be waived for one of the individuals if a special power of attorney properly executed by that individual is presented to the county clerk. The special power of attorney shall include a notarized statement authorizing a domestic partnership with the individual appearing in person.",

and thence referred to the JUDICIARY COMMITTEE.
