Mr. Speaker:

    Your HEALTH AND GOVERNMENT AFFAIRS COMMITTEE, to whom has been referred

HOUSE BILL 369

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

    1. On page 4, line 1, after “pharmacist” insert “and meets storage and labeling requirements of this act”.

    2. On page 4, line 20, strike “,in consultation with” and insert in lieu thereof “and”.

3. On page 5, lines 9 through 15, strike Subsection H in

its entirety and insert in lieu thereof the following new subsection:

         "H. A drug manufacturer shall not, in the absence of bad faith, be subject to criminal prosecution or liability in tort or other civil action for injury, death or loss to person or property for matters related to the donation by any person under the program, including failure to transfer or communicate product or consumer information or the expiration date of the donated drug.".,

and thence referred to the BUSINESS AND INDUSTRY COMMITTEE.
