Mr. Speaker:

    Your APPROPRIATIONS AND FINANCE COMMITTEE, to whom has been referred

HOUSE BILL 331, as amended

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. On page 35, line 16, after "revenue" insert ", except appropriations in the General Appropriation Act of 2009,".

     2. On page 42, line 21, strike "three" and insert in lieu thereof "ten".

     3. On page 77, line 8, after "DATE", insert "--CONTINGENCY".

     4. On page 77, between lines 17 and 18, insert the following new subsection:

          "D. The provisions of Subsections A through C of this section shall not be effective unless House Bill 346, Senate Bill 389 or Senate Bill 412 of the first session of the forty-ninth legislature becomes law and increases state revenue by at least three hundred fifty million dollars ($350,000,000) for fiscal year 2011.".
