AN ACT

RELATING TO MILITARY AFFAIRS; ESTABLISHING THE SALARIES OF THE ADJUTANT GENERAL AND THE DEPUTY ADJUTANT GENERAL.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. Section 9-9-1 NMSA 1978 (being Laws 1977, Chapter 258, Section 1) is amended to read:

     "9-9-1. SHORT TITLE.--[This act] Chapter 9, Article 9 NMSA 1978 may be cited as the "Military Affairs Act"."

     Section 2. A new section of the Military Affairs Act is enacted to read:

     "[NEW MATERIAL] ADJUTANT GENERAL--DEPUTY ADJUTANT GENERAL--SALARIES.--

          A. The salary of the adjutant general shall be the average of the two highest salaries of the heads of all cabinet-level departments or agencies except for that of the adjutant general.

          B. The salary of the deputy adjutant general shall be seventy-five percent of the salary of the adjutant general."

     Section 3. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2009.
