FOR THE CAPITOL BUILDINGS PLANNING COMMISSION

AN ACT

RELATING TO STATE BUILDINGS; ALLOCATING A PORTION OF APPROPRIATIONS FOR CERTAIN NEW CONSTRUCTION OR MAJOR RENOVATIONS TO THE PUBLIC BUILDINGS REPAIR FUND; MAKING AN APPROPRIATION.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the Property Control Act is enacted to read:

     "[NEW MATERIAL] ALLOCATION OF CONSTRUCTION APPROPRIATIONS TO THE PUBLIC BUILDINGS REPAIR FUND.--An amount equal to two percent of the amount appropriated for new construction, or any major renovation exceeding one hundred thousand dollars ($100,000), of any state building subject to the jurisdiction of the division shall be allocated to the public buildings repair fund. The secretary of finance and administration shall transfer the amount allocated from each applicable appropriation to the public buildings repair fund."

     Section 2. APPLICABILITY.--The provisions of this act apply to appropriations made by the legislature on or after January 1, 2010.
