AN ACT

MAKING AN APPROPRIATION TO PROVIDE NEW MEXICO-GROWN FRESH FRUITS AND VEGETABLES FOR SCHOOL MEALS AND SNACKS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. APPROPRIATION.--Three million three hundred thousand dollars ($3,300,000) is appropriated from the general fund to the board of regents of New Mexico state university for expenditure in fiscal year 2010 for the New Mexico department of agriculture to purchase New Mexico-grown fresh fruits and vegetables and to administer a program ensuring that fresh fruits and vegetables are delivered to school lunch programs statewide. Any unexpended or unencumbered balance remaining at the end of fiscal year 2010 shall revert to the general fund.
