AN ACT
RELATING TO HEALTH; INCREASING THE MEMBERSHIP OF THE BOARD OF TRUSTEES OF THE MINERS' HOSPITAL OF NEW MEXICO.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. Section 23-3-2 NMSA 1978 (being Laws 1975, Chapter 19, Section 1) is amended to read:
"23-3-2. BOARD CREATED--TERMS--COMPOSITION--COMPENSATION.--
A. There is created the "board of trustees of the miners' hospital of New Mexico". The board shall consist of [five] nine members appointed by the governor with the advice and consent of the senate. [One member] Three members of the board shall be [a licensed physician] health care practitioners, at least one of whom shall be a licensed physician and at least one of whom shall be a registered, certified or licensed nurse pursuant to the Nursing Practice Act; two members shall be miners or their representatives; [and] two members shall be representatives of the general public; one member shall be a registered or certified public accountant pursuant to the 1999 Public Accountancy Act or a licensed attorney; and one member shall be an official or member of a major interest group, organization or industry related to mining in New Mexico. At least three of the nine members shall be residents of Colfax county. Members of the board shall be appointed for staggered terms of five years each [except that the initial board shall be composed of one member appointed for a term of one year, one member appointed for a term of two years, one member appointed for a term of three years, one member appointed for a term of four years and one member appointed for a term of five years]. The governor shall make initial board appointments for terms so that the staggered terms of two members expire annually, except that once every five years the term of one member will expire.
B. A majority of the board shall constitute a quorum for doing business.
C. Members of the board shall receive per diem and mileage as provided in the Per Diem and Mileage Act and shall receive no other compensation, perquisite or allowance."
Section 2. TEMPORARY PROVISION--CURRENT BOARD MEMBERS TO SERVE OUT THEIR TERMS.--The current members of the board of trustees of the miners' hospital of New Mexico shall serve out their current terms. The governor shall appoint, with the advice and consent of the senate, four additional members to the board of trustees of the miners' hospital of New Mexico, one member for a term of two years, one member for a term of three years, one member for a term of four years and one member for a term of five years. After the initial appointments of the four additional board members, all board members shall serve terms of five years.
