AN ACT

MAKING APPROPRIATIONS FOR SALARY INCREASES FOR PUBLIC OFFICERS AND EMPLOYEES, PUBLIC SCHOOL PERSONNEL AND HIGHER EDUCATION FACULTY AND EMPLOYEES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. APPROPRIATIONS.--

          A. Thirty-one million nine hundred eighty-five thousand eight hundred dollars ($31,985,800) is appropriated from the general fund to the department of finance and administration for expenditure in fiscal year 2009 to provide salary increases to employees in budgeted positions, subject to satisfactory or better job performance. The salary increases shall be effective July 1, 2008, and the appropriation shall be distributed as follows:

                (1) nine hundred forty thousand seven hundred dollars ($940,700) to provide the justices of the supreme court; the chief judge of the court of appeals; judges of the court of appeals, district courts, metropolitan courts and magistrate courts; child support hearing officers; and special commissioners with a four percent salary increase;

                (2) three million two hundred thirty-six thousand two hundred dollars ($3,236,200) to provide all judicial permanent employees, other than employees whose salaries are set by statute, with an average four percent salary increase based on employee job performance as determined by the administrative office of the courts;

                (3) seventy-two thousand three hundred dollars ($72,300) to provide a four percent salary increase for district attorneys;

                (4) one million six hundred seventy-three thousand seven hundred dollars ($1,673,700) to provide all district attorney permanent employees, other than elected district attorneys, with an average four percent salary increase based on employee job performance as determined by the administrative office of the district attorneys;

                (5) twenty-one million three hundred eighty-eight thousand three hundred dollars ($21,388,300) to provide incumbents in agencies governed by the Personnel Act with a four percent salary increase based on employee performance as determined by the personnel board;

                (6) one million nine hundred twenty-four thousand seven hundred dollars ($1,924,700) to provide executive exempt employees, including attorney general employees and workers' compensation judges, with a four percent salary increase;

                (7) one million five hundred thirty-one thousand three hundred dollars ($1,531,300) to provide all commissioned officers of the New Mexico state police division of the department of public safety with a four percent general salary increase in accordance with the New Mexico state police career pay system as determined by the secretary of public safety and the personnel board;

                (8) two hundred seventy thousand eight hundred dollars ($270,800) to provide teachers in the department of health; corrections department; children, youth and families department; and the New Mexico school for the blind and visually impaired with a four percent salary increase;                     (9) five hundred thirty-six thousand three hundred dollars ($536,300) to provide permanent legislative employees, including permanent employees of the legislative council service; the legislative finance committee; the legislative education study committee; legislative building services; the house and senate chief clerks' offices; and the house and senate leadership with an average four percent salary increase; and

                (10) four hundred eleven thousand five hundred dollars ($411,500) for an additional two percent increase for staff attorneys of district attorneys.

          B. The following amounts are appropriated from the general fund to the higher education department for expenditure in fiscal year 2009:

                (1) twenty-five million four hundred one thousand six hundred dollars ($25,401,600) to provide all faculty and staff of four- and two-year public post-secondary educational institutions with a three percent salary increase. The salary increases shall be effective July 1, 2008; and

                (2) six million three hundred fifty thousand four hundred dollars ($6,350,400) to provide a statutorily mandated increase in the employer contribution to the educational retirement fund.

          C. The following amounts are appropriated from the general fund to the public education department for expenditure in fiscal year 2009:

                (1) sixty million one hundred twenty-nine thousand nine hundred dollars ($60,129,900) to provide all public school employees with a three percent salary increase. The salary increases shall be effective July 1, 2008;

                (2) one million five hundred fifty-seven thousand nine hundred dollars ($1,557,900) to provide an additional one percent salary increase to secretarial, clerical, technical assistant, custodial, warehouse and delivery employees; and

                (3) fifteen million thirty-two thousand five hundred dollars ($15,032,500) to provide a statutorily mandated increase in the employer contribution to the educational retirement fund.

          D. The department of finance and administration shall distribute a sufficient amount to each agency to provide the appropriate increase for those employees whose salaries are received as a result of the general fund appropriations in the General Appropriation Act of 2008. Any unexpended or unencumbered balance remaining at the end of fiscal year 2009 shall revert to the general fund.

          E. For those state employees whose salaries are referenced in or received as a result of nongeneral fund appropriations in the General Appropriation Act of 2008, the department of finance and administration shall transfer from the appropriate fund to the appropriate agency the amount required for the salary increases equivalent to those provided for in this section, and such amounts are appropriated for expenditure in fiscal year 2009. Any unexpended or unencumbered balance remaining at the end of fiscal year 2009 shall revert to the appropriate fund.
