SENATE FLOOR AMENDMENT number ___1___ toSENATE FINANCE COMMITTEE SUBSTITUTE FOR SENATE BILL 1130, as amended

Amendment sponsored by Senator Stuart Ingle

    1. On page 1, line 15, after the semicolon, insert "REQUIRING APPLICANT ENTITIES TO WAIVE CONFIDENTIALITY AND PROVIDE FINANCIAL INFORMATION IN ORDER TO QUALIFY FOR LOAN GUARANTEES;".

    2. On page 8, between lines 9 and 10, insert the following new paragraph:

             "(13) in order to qualify for a loan guarantee pursuant to this section, an applicant entity shall waive state and federal confidentiality laws or provisions, including the provisions of Section 6-25-27 NMSA 1978. The applicant entity shall provide information, which may be publicly disclosed, that is sufficient to allow the state board of finance, the legislative finance committee and the New Mexico finance authority oversight committee to evaluate the application for loan guarantee, including the identities and net worth of stockholders holding more than five percent of the applicant entity seeking a loan guarantee and the net worth of the applicant entity.".

    3. Renumber the succeeding paragraphs accordingly.
