Your FINANCE COMMITTEE, to whom has been referred
SENATE BILL 1095, as amended
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. Strike Senate Education Committee Amendment 3.
2. On page 1, line 13, strike "; MAKING AN APPROPRIATION".
3. On page 2, line 9, after "Act" strike the remainder of the line, strike lines 10 through 13 in their entirety and strike line 14 up to the semicolon.
4. On page 3, strike Section 3 in its entirety and insert in lieu thereof the following new subsection:
"Section 3. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2008.".
5. On page 3, between lines 16 and 17, insert the following new section:
"Section 3. A new section of the Public School Insurance Authority Act is enacted to read:
"[NEW MATERIAL] DUE PROCESS REIMBURSEMENT.--The authority shall include due process reimbursement in its self-insured retention risk pool. Each year, the legislature shall authorize the board to collect the due process reimbursement premium from school districts and charter schools to cover the cost of due process reimbursement. From the authorization, the board shall allocate due process reimbursement premiums based on a school district's or charter school's claims experience and other criteria determined by the board. A single due process reimbursement shall not exceed three hundred thousand dollars ($300,000)."".
6. Renumber the succeeding section accordingly.
