AN ACT
RELATING TO GRAFFITI; REQUIRING RETAILERS TO CONTROL ACCESS TO SPRAY PAINTS AND FELT-TIP PERMANENT MARKERS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. RETAIL SALE OF SPRAY PAINT AND FELT-TIP PERMANENT MARKERS--CONTROLLED ACCESS.--
A. A retailer that sells paint in spray cans shall control access to the spray cans by keeping them on a shelf or other area that is enclosed on four sides and locked.
B. A retailer that sells felt-tip permanent markers shall keep them behind counters that are staffed or by otherwise controlling access to the markers.
