Your EDUCATION COMMITTEE, to whom has been referred
SENATE BILL 287
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 18, line 16, strike "in corrective action" and insert in lieu thereof "pursuant to Subsections B through H of this section".
2. On page 18, line 24, strike "reopen" and insert in lieu thereof "recommend reopening".
3. On page 20, line 1, strike the end quotation marks and between lines 1 and 2, insert the following new subsection:
"N. Nothing in this section shall be construed to restrict the powers and duties of the secretary or the department under the Public School Code."".
4. On page 20, strike lines 7 through 12 and insert in lieu thereof:
"A. If, pursuant to Subsections I and J of Section 22-2C-7 NMSA 1978, the school district in which a public school that has failed to make adequate yearly progress for five consecutive years recommends that the public school be reopened as a state-chartered charter school, the department, after holding a public hearing in the school district, may take steps to have the public school reopened as a state-chartered charter school.".
5. On page 20, line 19, after "department" insert ", after obtaining information and community input during the public hearing,".
6. On page 20, line 20, after "serve" insert "in an interim capacity".
and thence referred to the JUDICIARY COMMITTEE.
