AN ACT
RELATING TO HEALTH COVERAGE; PROVIDING COVERAGE IN CERTAIN HEALTH COVERAGE PLANS FOR PERSONS WITH HOUSEHOLD INCOMES LESS THAN THREE HUNDRED PERCENT OF THE FEDERAL POVERTY GUIDELINES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. A new section of Chapter 27 NMSA 1978 is enacted to read:
"[NEW MATERIAL] SPECIAL PROGRAM ELIGIBILITY.--A person covered by a state-sponsored health coverage plan pursuant to a federal health insurance flexibility and accountability medicaid waiver that includes federal, state, employer and employee or individual premium contributions is eligible for coverage if the person's household income is below three hundred percent of the federal poverty guidelines as published annually by the federal department of health and human services."
