    Your AGRICULTURE AND WATER RESOURCES COMMITTEE, to whom has been referred

HOUSE BILL 1278

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

    1. On page 1, line 13, after "SETTLEMENT" insert "; DECLARING AN EMERGENCY". 

     2. On page 2, line 3, after "of" insert "the Carlsbad irrigation district,".

     3. On page 2, line 15, after "the" insert "Carlsbad irrigation district, the" and before "Pecos" insert "the".

     4. On page 2, line 16, after "or" insert "between the Acme gauge to and including".

     5. On page 2, line 17, strike "and".

     6. On page 2, line 24, strike the period and insert in lieu thereof "; and".

     7. On page 2, between lines 24 and 25, insert the following new paragraph to read:

                "(3) the purchase of water rights or rights to the delivery of water and subsequent use of the land to which the rights are appurtenant comply with the provisions of Section 5D(1) and (2) of the settlement agreement dated March 25, 2003 entered in State v. Lewis.".

     8. On page 5, between lines 1 and 2, insert the following new section to read: 

     "Section 3. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.".,

and thence referred to the ENERGY AND NATURAL RESOURCES COMMITTEE.
