    Your JUDICIARY COMMITTEE, to whom has been referred

HOUSE BILL 832, as amended

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. On page 2, line 1, remove the brackets and line through "department" and strike the underscored language.

     2. On page 2, line 3, remove the brackets and line through "department" and strike the underscored language.

     3. On page 2, line 5, remove the brackets and line through "department" and strike the underscored language.

     4. On page 3, line 7, after “claim” insert “by the provider”.

     5. On page 3, line 15, strike the closing quotation mark.

     6. On page 3, between lines 15 and 16, insert the following new subsection:

          "D. Nothing in this section shall be construed to preclude the application of common law principles in determining equitable reimbursement from any third-party source for New Mexico or a health insurer, including self-insured plans, group health plans, service benefit plans, managed care organizations, pharmacy benefit managers or other parties."".
