AN ACT
RELATING TO STATE HIGHWAYS; REQUIRING LEGISLATIVE APPROVAL OF PROPOSED RESTRICTIONS ON USE OF STATE HIGHWAYS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. A new section of Chapter 67, Article 3 NMSA 1978 is enacted to read:
"[NEW MATERIAL] LIMITATION ON USE OF STATE HIGHWAYS--LEGISLATIVE APPROVAL.--A restriction on the use of a state highway in a class A county with a population of more than three hundred thousand persons for a period exceeding two years, including restricting use by commercial motor vehicles based on size or weight, shall be subject to the approval of the state legislature prior to the limitation becoming effective. This section shall not apply to emergency restrictions or restrictions based on structural or safety concerns."
