AN ACT
RELATING TO ELECTIONS; REQUIRING COUNTY CLERKS TO PROVIDE A MINIMUM NUMBER OF BALLOTS TO PRECINCTS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. Section 1-10-2 NMSA 1978 (being Laws 1977, Chapter 222, Section 25) is amended to read:
"1-10-2. BALLOTS--DUTY TO PROVIDE.--
A. The county clerk shall prepare and supply the ballots used in elections conducted under the Election Code. Ballots other than those prepared by the county clerk shall not be used in such elections.
B. The county clerk shall provide to each precinct a number of ballots equal to the number of voters in each precinct less the estimated number of absentee voters in the precinct. At least ten days before any election, the county clerk shall make available for public inspection a list of the number of ballots the clerk will provide to each precinct.
C. As used in this section, "absentee voter" means a voter who casts a vote for any candidate or question prior to election day, by mail on an absentee ballot, in person on an absentee ballot or in person on a voting machine."
