AN ACT

MAKING APPROPRIATIONS FOR SALARY INCREASES FOR PUBLIC OFFICERS AND EMPLOYEES, PUBLIC SCHOOL PERSONNEL AND HIGHER EDUCATION FACULTY AND EMPLOYEES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. APPROPRIATIONS.--

          A. Forty-three million nine hundred seventy-two thousand eight hundred ninety-nine dollars ($43,972,899) is appropriated from the general fund to the department of finance and administration for expenditure in fiscal year 2008 to provide salary increases to employees in budgeted positions, subject to satisfactory or better job performance. The salary increases shall be effective the first pay period after July 1, 2007, and the appropriation shall be distributed as follows:

                (1) one million twenty-four thousand sixty dollars ($1,024,060) to provide the justices of the supreme court; the chief judge of the court of appeals; judges of the court of appeals, district courts, metropolitan courts and magistrate courts; child support hearing officers; and special commissioners with a five percent salary increase;

                (2) three million eight hundred fifty-nine thousand four hundred fifteen dollars ($3,859,415) to provide all judicial permanent employees, other than employees whose salaries are set by statute, with a two percent salary increase and an average three percent adjustment based on employee job performance and compa-ratio as determined by the administrative office of the courts;

                (3) eighty-six thousand fifty dollars ($86,050) to provide a five percent salary increase for district attorneys;

                (4) two million two hundred ninety-six thousand four hundred fifty dollars ($2,296,450) to provide all district attorney permanent employees, other than elected district attorneys, with a two percent salary increase and an average three percent adjustment based on employee job performance and compa-ratio as determined by the administrative office of the district attorneys;

                (5) twenty-five million one hundred fifty-eight thousand six hundred eleven dollars ($25,158,611) to provide incumbents in agencies governed by the Personnel Act with a two percent salary increase and an average three percent adjustment based on employee performance and compa-ratio as determined by the personnel board;

                (6) two million one hundred thirty-eight thousand six hundred ninety-three dollars ($2,138,693) to provide executive exempt employees, including attorney general employees and workers' compensation judges, with an average five percent salary increase;

                (7) one million five hundred sixty-five thousand eighty dollars ($1,565,080) to provide all commissioned officers of the New Mexico state police division of the department of public safety with a five percent general salary increase in accordance with the New Mexico state police career pay system as determined by the secretary of public safety and the personnel board;

                (8) three hundred fifty-three thousand four hundred fifty-five dollars ($353,455) to provide teachers in the department of health; corrections department; children, youth and families department; and the school for the blind and visually impaired with a four and one-fourth percent salary increase and for statutory minimum salaries for level three-A teachers;

                (9) five hundred thirty thousand twenty-five dollars ($530,025) to provide permanent legislative employees, including permanent employees of the legislative council service; the legislative finance committee; the legislative education study committee; legislative building services; the house and senate chief clerks' offices; and the house and senate leadership with an average five percent salary increase;

                (10) four million five hundred sixty-eight thousand seven hundred ten dollars ($4,568,710) for an additional five percent salary increase for state employees classified as correctional officers; juvenile correctional officers; librarians, library technicians and library assistants; and attorneys of the public defender department.

                (11) one million two hundred sixty thousand three hundred fifty dollars ($1,260,350) for an additional seven percent increase for state employees classified as probation and parole officers; and

                (12) one million one hundred thirty-two thousand dollars ($1,132,000) for an additional five percent increase for staff attorneys of district attorneys as determined by a plan submitted to the administrative office of the district attorneys and the legislative finance committee.

          B. Thirty-five million two hundred ninety-two thousand four hundred four dollars ($35,292,404) is appropriated from the general fund to the higher education department for expenditure in fiscal year 2008 to provide faculty and staff of four- and two-year public post-secondary educational institutions with a four and one-fourth percent compensation increase. The compensation increases shall be effective the first pay period after July 1, 2007.

          C. The following amounts are appropriated from the general fund to the public education department for expenditure in fiscal year 2008:

                (1) seventy-eight million nine hundred thirty-two thousand eight hundred eleven dollars ($78,932,811) to provide all public education employees with a four and one-fourth percent salary increase;

                (2) ten million seven hundred thirty-nine thousand one hundred dollars ($10,739,100) for statutory minimum salaries for level three-A teachers; and

                (3) fourteen million five hundred six thousand eight hundred dollars ($14,506,800) to provide a three-fourths percent increase in the employer contribution to the educational retirement fund. The compensation increase shall be effective the first pay period after July 1, 2007.

          D. The department of finance and administration shall distribute a sufficient amount to each agency to provide the appropriate increase for those employees whose salaries are received as a result of the general fund appropriations in the General Appropriation Act of 2007. Any unexpended or unencumbered balance remaining at the end of fiscal year 2008 shall revert to the general fund.

          E. For those state employees whose salaries are referenced in or received as a result of nongeneral fund appropriations in the General Appropriation Act of 2007, the department of finance and administration shall transfer from the appropriate fund to the appropriate agency the amount required for the salary increases equivalent to those provided for in this section, and such amounts are appropriated for expenditure in fiscal year 2008. Any unexpended or unencumbered balance remaining at the end of fiscal year 2008 shall revert to the appropriate fund.
