HOUSE BILL 3

 

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

 

     1. On page 2, line 11, strike "2,121,877.4" and insert in lieu thereof "2,159,326.9".

 

     2. On page 2, line 21, strike "pre-kindergarten" and insert in lieu thereof "kindergarten".

 

     3. On page 4, strike lines 1 through 10 and insert in lieu thereof:

 

     "The general fund appropriation for the state equalization guarantee distribution contains sufficient funds to provide a six percent salary increase for all teachers, a nine and one-half percent salary increase for educational assistants and an average six percent salary increase for other instructional staff and other licensed and nonlicensed staff, effective the first full pay period after July 1, 2006. Prior to the approval of a school district's or a charter school's budget, the secretary of public education shall verify that each school district or charter school is providing a six percent salary increase for all teachers and a nine and one-half percent salary increase for educational assistants.

 

     The general fund appropriation for the state equalization guarantee distribution contains sufficient funds to implement the forty-five-thousand-dollar ($45,000) minimum salary and to accelerate the implementation of the fifty-thousand-dollar ($50,000) minimum salary for level three-A teachers. The secretary of public education shall verify that school districts and charter schools have implemented the salary increases for teachers prior to implementing the minimum salaries for level three-A teachers.".

 

     4. On page 5, line 7, under the General Fund column, strike "104,586.5" and insert in lieu thereof "108,709.4".

 

     5. On page 5, line 9, strike "four and one-half" and insert in lieu thereof "six".

 

     6. On page 5, line 10, before "July", insert "the first full pay period after".

 

     7. On page 6, line 2, under the General Fund column, strike "2,100.0" and insert in lieu thereof "2,400.0".

 

     8. On page 6, line 8, strike "10,419.0" and insert in lieu thereof "10,588.1".

     15. On page 7, between lines 2 and 3, insert language and amounts under the General Fund column:

 

      "The general fund appropriation to the public education department for the Indian Education Act includes one million dollars ($1,000,000) to contract with a nonprofit organization to provide a rural literacy initiative to support new after-school and summer literacy block programs for students in grades kindergarten through eighth grade in schools with a high proportion of Native American students, contingent on receipt of five hundred thousand dollars ($500,000) in matching funds from sources other than the state.

 

     The general fund appropriation to the public education department for truancy/dropout prevention includes two hundred thirty thousand dollars ($230,000) to the second judicial district court for truancy court.

     The general fund appropriation to the public education department for the early literacy initiative is for school district and charter school research-based after-school and summer literacy programs.

 

     The general fund appropriation to the public education department for regional education cooperatives temporary cash flow assistance is to be used to cover costs associated with federal reimbursement requirements. The public education department may advance amounts to one or more regional education cooperatives upon a finding that the cooperative has a timely audit, is in compliance with financial reporting requirements, is otherwise financially stable and has adequately justified a need for the advance. A regional education cooperative shall return the general fund advance to the public education department by June 30, 2007. Funds returned to the public education department shall not revert to the general fund and shall remain available for advances to regional education cooperatives in fiscal year 2008.

 

     The general fund appropriation to the public education department for the state-support reserve fund is to augment the appropriations of the state equalization guarantee distribution pursuant to Subsection B of Section 22-8-31 NMSA 1978 and to provide for emergency needs of school districts with a membership of two hundred or fewer and, if available funds permit, other school districts over and above the emergency distributions provided to school districts in financial need pursuant to Paragraph (2) of Subsection A of Section 22-8-30 NMSA 1978. The secretary of public education shall certify that a school district has exhausted its resources, including any supplemental distribution, before providing emergency funding from the state-support reserve fund.

 

     The general fund appropriation to the public education department for the teacher professional development fund is to be used to fund re: learning, regional educational technology assistance, strengthening quality in schools, service learning, golden apple, closing the achievement gap, leadership academy and other professional development programs. In fiscal year 2007, the public education department shall evaluate programs funded through the teacher professional development fund and provide a report to the legislative education study committee by November 2006.

 

     The general fund appropriation to the public education department for the three-tiered transition is to address shortfalls experienced by school districts and charter schools in implementing the minimum salary for level three-A teachers. The secretary of public education shall verify the amount needed by each school district and charter school prior to distributing the funds.".

 

      16. On page 7, between lines 13 and 14, insert the following with the amounts under the General Fund column:

       

      "COMPUTER SYSTEMS ENHANCEMENT FUND                     2,000.0

 

      To support the continued implementation of a comprehensive data warehouse at the public education department.

             

      LEGISLATIVE COUNCIL SERVICE                            1,000.0

 

     To the legislative council service to pay costs associated with a public school funding formula study, including costs to contract with one or more experts.

      HIGHER EDUCATION DEPARTMENT                            1,200.0

 

      To the higher education department to be distributed to the university of New Mexico, New Mexico state university and Santa Fe community college to fund the ENLACE program.

       

      NEW MEXICO STATE UNIVERSITY                           500.0.

 

     To the board of regents of New Mexico state university to fund a statewide demonstration school leadership program in the center for border and indigenous educational leadership.".

       

      17. Revise all totals and subtotals to correspond with these amendments.,
