AN ACT
RELATING TO GAMING; REQUIRING LEGISLATIVE AUTHORIZATION FOR CLASS III GAMING CONDUCTED ON LANDS ACQUIRED IN TRUST AFTER OCTOBER 17, 1988; DECLARING AN EMERGENCY.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. Section 11-13A-1 NMSA 1978 (being Laws 1999, Chapter 252, Section 1) is amended to read:
"11-13A-1. SHORT TITLE.--[This act] Chapter 11, Article 13A NMSA 1978 may be cited as the "Compact Negotiation Act"."
Section 2. A new section of the Compact Negotiation Act is enacted to read:
"[NEW MATERIAL] GAMING ON LANDS ACQUIRED IN TRUST AFTER OCTOBER 17, 1988--LEGISLATIVE AUTHORIZATION REQUIRED.--The governor may not concur in a determination by the federal government that class III gaming may be conducted on lands in this state acquired by the federal government in trust for the benefit of an Indian tribe after October 17, 1988 until the legislature first authorizes the governor to concur by a joint resolution."
Section 3. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
