    Your PUBLIC AFFAIRS COMMITTEE, to whom has been referred

SENATE BILL 862

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

    1. On page 1, line 12, strike "PETITION" and insert in lieu thereof "REQUEST".

    2. On page 1, line 13, strike "PACKAGE".

    3. On page 1, line 14, strike "PETITION" and insert in lieu thereof "REQUEST".

     4. On page 2, strike lines 10 and 11 in their entirety and on line 12 strike "license" and insert in lieu thereof "request from that restaurant to allow any restaurant in that municipality or county to apply for a restaurant license,".

    5. On page 2, line 14, strike "petition" and insert in lieu thereof "request".

    6. On page 2, line 22, strike "petition" and insert in lieu thereof "request".

    7. On page 3, line 2, strike "petition" and insert in lieu thereof "request".

    8. On page 5, line 13, strike "A" and insert in lieu thereof "Subject to the provisions of Subsections E, J and K of this section, a".

    9. On page 5, lines 19 and 20, strike ", except as otherwise provided in Subsection E of this section".

    10. On page 6, line 17, remove the brackets and line-through and after "J" insert "or".

    11. On page 9, line 10, remove the brackets and line-through.

    12. On page 9, line 11, strike "Subsections I and J".

    13. On page 9, lines 23 and 24, strike "Except as provided in Subsection J of this section, if" and insert in lieu thereof "If".

    14. On page 11, lines 2 through 14, strike Subsection J in its entirety and insert the following new Subsection J:

         "J. Sunday sales of alcoholic beverages by the drink on the licensed premises may be permitted in a municipality with a population over five thousand persons that has voted, pursuant to Subsection E of this section, not to allow Sunday sales or in a county that has voted, pursuant to Subsection E of this section, not to allow Sunday sales if the governing body of the municipality or county grants a request from a dispenser, restaurant or club licensee to allow Sunday sales in that municipality or county, notwithstanding that the municipality or county has voted not to allow Sunday sales. If the governing body grants the request, a copy of its ordinance, resolution or other pronouncement evidencing the grant shall be submitted to the director, and dispenser, restaurant and club licensees in that municipality or county may obtain permits for Sunday sales pursuant to Subsection C of this section.".,

and thence referred to the JUDICIARY COMMITTEE.
