AN ACT

RELATING TO CIVIL LAW; RELEASING RADIO OR TELEVISION BROADCAST ORGANIZATIONS FROM CIVIL LIABILITY FOR BROADCASTS MADE PURSUANT TO THE AMBER ALERT LAW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. Section 29-15A-1 NMSA 1978 (being Laws 2003, Chapter 93, Section 1) is amended to read:

     "29-15A-1. SHORT TITLE.--[This act] Chapter 29, Article 15A NMSA 1978 may be cited as the "AMBER Alert Law"."

     Section 2. A new section of the AMBER Alert Law is enacted to read:

     "[NEW MATERIAL] RELEASE FROM LIABILITY.--A radio or television broadcast organization or its officers, directors, managers, employees or agents shall not be held liable for civil damages of any kind connected with the notification and broadcast of information provided by federal, state and local law enforcement agencies and made pursuant to the AMBER Alert Law."

     Section 3. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2005.
