AN ACT
MAKING APPROPRIATIONS TO THE ENERGY, MINERALS AND NATURAL RESOURCES DEPARTMENT FOR STATE PARKS; EXTENDING THE EXPENDITURE DATE AND EXPANDING THE PURPOSE OF A PRIOR APPROPRIATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. APPROPRIATIONS--EXTENDING EXPENDITURE PERIOD--EXPANDING PURPOSE.--
A. The appropriation to the energy, minerals and natural resources department made in Item (55) of Section 5 of Chapter 114 of Laws 2004 for nonrecurring capital costs associated with the expansion of five existing state parks and the costs associated with building four new state parks may be expended in fiscal year 2005 and subsequent fiscal years and shall not revert to the general fund at the end of a fiscal year. The appropriation also may be used for projects at Cerrillos hills park in Santa Fe county and the Blackwater Draw site in Roosevelt county.
B. Notwithstanding the purpose of the appropriation made in Item (55) of Section 5 of Chapter 114 of Laws 2004, two hundred fifty thousand dollars ($250,000) may be expended to pay for the capital equipment and operational expenses associated with opening the proposed Vietnam veterans' memorial state park in Colfax county.
C. Two hundred four thousand two hundred dollars ($204,200) is appropriated from the general fund to the energy, minerals and natural resources department for expenditure in fiscal year 2006 and subsequent fiscal years to pay for the operations of the proposed Vietnam veterans' memorial state park in Colfax county. Any unexpended or unencumbered balance remaining at the end of a fiscal year shall not revert to the general fund.
D. The appropriations made in Subsections B and C of this section are contingent on the state parks division of the energy, minerals and natural resources department acquiring ownership of the property for the Vietnam veterans' memorial state park.
