Your JUDICIARY COMMITTEE, to whom has been referred
SENATE JUDICIARY COMMITTEE SUBSTITUTE FOR
SENATE BILL 166, as amended
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. Strike Senate Floor Amendment 1.
2. On page 1, line 12, after "INTENTIONAL" strike the remainder of the line, strike line 13 in its entirety and insert in lieu thereof "ABUSE OF A CHILD LESS THAN TWELVE YEARS OF AGE THAT RESULTS IN THE CHILD'S DEATH.".
3. On page 3, lines 7 and 8, remove the brackets and line-through.
4. On page 3, line 7, after "harm" strike "or death".
5. On page 3, strike lines 9 through 19 in their entirety and insert in lieu thereof the following new subsections:
"F. Whoever commits negligent abuse of a child that results in the death of the child is guilty of a first degree felony.
G. Whoever commits intentional abuse of a child twelve to eighteen years of age that results in the death of the child is guilty of a first degree felony.
H. Whoever commits intentional abuse of a child less than twelve years of age that results in the death of the child is guilty of a first degree felony resulting in the death of a child.".
6. On page 4, line 13, strike "human being" and insert in lieu thereof "child".
7. On page 6, line 16, strike "human being" and insert in lieu thereof "child".
8. On page 8, line 17, strike "human being" and insert in lieu thereof "child".
