SUMMARY
The SRC amendment changes the citation which
references county road supervisors to the correct citation of
SB 652 changes current law that requires Highway
Commissioners to only be removed for incompetence, neglect of duty or
malfeasance in office. This bill
provides that Highway Commissioners will serve at the pleasure of the
governor. SB 652 has an emergency
clause.
CONFLICT
SB652 conflicts with
HB810 which provides that a Highway Commissioner may be removed pursuant to a
joint resolution of the legislature, passed by a two third’s vote in each
house.
TECHNICAL ISSUES
SB 652 references current statute, Section
67-4-5 NMSA 1978, that relates to county road supervisors. The proper section
in current statute related to State Highway Commissioners is Section 67-3-2,
Subsection A, NMSA 1978. This is a
technical change needed for the bill to be accurate.
