SUMMARY

 

     Synopsis of Bill

 

House Bill 557 amends Section 24-1-2 NMSA to include residential treatment centers, community mental health centers and day treatment centers providing services to youth up to 21 years of age as requiring licensure by CYFD.

 

     Significant Issues

 

This bill has the support of the state agencies impacted since it will clarify agency roles, responsibilities and reduce administrative time and effort.

 

Currently, Section 24-1-2 NMSA 1978 provides that CYFD licenses childcare centers and facilities and DOH licenses all other health facilities.  HPC states this bill would clarify the language and bring it into agreement with Medicaid regulations regarding the purposes of paid benefit for these services.

 

DOH also concurs that the bill will make it clear that mental health centers serving children up to 21 years are subject to CYFD licensing.  This clarification is consistent with the current practice between CYFD and DOH.  This change will enable these mental health programs to be licensed by CYFD and then funded by Medicaid.

 

ADMINISTRATIVE IMPLICATIONS

 

According to DOH, this bill would reduce administrative workload for the agency.  Currently, CYFD does the inspections and DOH issues the license.  This bill would put these tasks under CYFD.  Currently, these practices are covered by a Memorandum of Understanding between CYFD, DOH and the Human Services Department.
