FOR THE TOBACCO SETTLEMENT REVENUE OVERSIGHT COMMITTEE



AN ACT

RELATING TO TOBACCO SETTLEMENT REVENUE; MAKING APPROPRIATIONS FROM THE TOBACCO SETTLEMENT PROGRAM FUND.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. APPROPRIATIONS.--

A. The following amounts are appropriated from the tobacco settlement program fund to the following agencies for the specified purposes for expenditure in fiscal year 2004:

(1) eight million dollars ($8,000,000) to the department of health for comprehensive tobacco use prevention and cessation programs that are community based, culturally appropriate and designed to achieve the "best practices" standards developed by the federal centers for disease control and prevention, including school-based youth and parent programs, media and public awareness campaigns and partnerships with disparate populations;

(2) one million dollars ($1,000,000) to the department of health for diabetes prevention and control;

(3) two million five hundred thousand dollars ($2,500,000) to the department of health for an early intervention program for at-risk children;

(4) four hundred seventy thousand dollars ($470,000) to the department of health for human immunodeficiency virus and acquired immune deficiency syndrome care and prevention;

(5) two hundred fifty thousand dollars ($250,000) to the department of health to fund inpatient treatment beds as an alternative to incarceration for women with a substance abuse history convicted of nonviolent felony offenses;

(6) two hundred fifty thousand dollars ($250,000) to the department of health for the statewide tobacco education prevention program;

(7) forty-two thousand dollars ($42,000) to the department of health for the purchase of a pulmonary function analyzer, office equipment and furniture for a collaborative program on chronic disease risk reduction in Taos county;

(8) one million dollars ($1,000,000) to the department of health to contract for the provision of diabetes testing equipment in rural clinics for uninsured patients, for computer equipment to track and monitor those patients and for the development of a diabetes collaborative;

(9) two hundred fifty thousand dollars ($250,000) to the department of health to provide automatic external defibrillators in state and local government buildings and vehicles;

(10) one million two hundred thousand dollars ($1,200,000) to the department of health to provide technology for primary care clinics statewide;

(11) two hundred thousand dollars ($200,000) to the department of health to contract for the implementation of a comprehensive cancer control plan;

(12) three hundred thousand dollars ($300,000) to the department of health to provide for linking medical information among the state's community access programs;

(13) one hundred thousand dollars ($100,000) to the department of health for public education on prostate cancer;

(14) three million eight hundred fifty thousand dollars ($3,850,000) to the board of regents of the university of New Mexico for the New Mexico health sciences center for research programs as follows:

(a) three hundred seventeen thousand six hundred dollars ($317,600) for genomics core facilities;

(b) one million sixty-two thousand three hundred dollars ($1,062,300) for epidemiology;

(c) one hundred fifty-three thousand five hundred dollars ($153,500) for enhanced tobacco-related research;

(d) nine hundred sixty thousand five hundred dollars ($960,500) for clinical research and trials; and

(e) one million three hundred fifty-six thousand one hundred dollars ($1,356,100) for biocomputing;

(15) one million nine hundred thousand dollars ($1,900,000) to the board of regents of the university of New Mexico for health programs as follows:

(a) fifty thousand dollars ($50,000) for area health education centers;

(b) one hundred fifty thousand dollars ($150,000) to the center for telehealth;

(c) fifty thousand dollars ($50,000) to the Los Pasos program;

(d) four hundred thousand dollars ($400,000) for pediatric oncology;

(e) four hundred fifty thousand dollars ($450,000) to the poison and drug information center;

(f) four hundred thousand dollars ($400,000) for specialty education in pediatrics; and

(g) four hundred thousand dollars ($400,000) for specialty education in trauma;

(16) one million seven hundred fifty thousand dollars ($1,750,000) to the board of regents of the university of New Mexico for the New Mexico health sciences center to contract for research on emphysema and lung cancer detection and treatment;

(17) one million three hundred thousand dollars ($1,300,000) to the human services department for a breast and cervical cancer treatment program;

(18) two hundred fifty thousand dollars ($250,000) to the corrections department to fund a women's reentry drug treatment court pilot project;

(19) fifty thousand dollars ($50,000) to the corrections department to fund the task force created pursuant to Senate Joint Memorial 48 of the second session of the forty-fifth legislature that is examining issues relating to the increase in the incarceration of females due to drug use and addiction; and

(20) six hundred thousand dollars ($600,000) to the New Mexico veterans' service commission to contract for an assisted living program for veterans with lung disease.

B. Any unexpended or unencumbered balance remaining at the end of fiscal year 2004 shall revert to the tobacco settlement program fund.
