Madam President:

Your CORPORATIONS AND TRANSPORTATION COMMITTEE, to whom has been referred

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

1. On page 2, line 4, after the period insert "In a county or municipality that has adopted a charter, the ordinance imposing the fee shall be subject to referendum as provided in the charter. In a municipality with a commission-manager form of government, the ordinance imposing the fee shall be subject to referendum as provided in Section 3-14-17 NMSA 1978. In all other counties and municipalities, the ordinance imposing the fee shall not go into effect until after an election is held and a simple majority of the registered voters voting in the election votes in favor of imposing the fee.".

2. On page 2, line 5, after "vehicles" strike the remainder of the line and all of line 6 and insert in lieu thereof "with a gross vehicle weight of less than twelve thousand pounds; provided that the fee shall not be imposed on motorcycles or manufactured homes or on vehicles that come within the definition of "vehicle" in the Leased Vehicle Gross Receipts Tax Act.".
