AN ACT

RELATING TO CHILD CARE; ESTABLISHING THE ELIGIBILITY AND PRIORITY FOR CERTAIN STATE CHILD CARE; MAKING AN APPROPRIATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. CHILD CARE ELIGIBILITY--PRIORITY.--Subject to the availability of state and federal funds, families whose incomes are at or below two hundred percent of the federal poverty level are eligible for child care assistance administered by the children, youth and families department. The department shall maintain a waiting list of all families eligible for but not receiving child care services due to lack of available funding. Families on the waiting list with the lowest eligible incomes shall receive priority for services. Section 2. APPROPRIATION.--Two million dollars ($2,000,000) is appropriated from the general fund to the children, youth and families department for expenditure in fiscal year 2004 for child care assistance. Any unexpended or unencumbered balance remaining at the end of fiscal year 2004 shall revert to the general fund.
