RELATING TO AVIATION; REVISING THE CRITERIA FOR IMPOSITION OF A LANDING FEE BY AN AIRPORT FACILITY; AMENDING A SECTION OF THE NMSA 1978.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. Section 64-1-16 NMSA 1978 (being Laws 1963, Chapter 314, Section 8, as amended) is amended to read:

"64-1-16. LANDING FEES.--[No] An airport facility [which] that receives funds under the Aviation Act shall not charge landing fees for aircraft, except for aircraft used in [scheduled air service or commercial aircraft in excess of 18,000 pounds maximum gross weight] commercial activities for compensation."

Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2002.
