AN ACT

MAKING AN APPROPRIATION TO THE WATER TRUST FUND.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. APPROPRIATION.--Ninety million dollars ($90,000,000) is appropriated from the general fund to the water trust fund for expenditure in fiscal year 2003 and subsequent fiscal years to carry out purposes of the Water Project Finance Act. This appropriation is contingent upon the state receiving an equal amount from Indian gaming

back-payment receipts pursuant to gaming compacts. Any unexpended or unencumbered balance remaining at the end of a fiscal year shall not revert to the general fund.
