Your PUBLIC AFFAIRS COMMITTEE, to whom has been referred



SENATE BILL 277



has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:



1. On page 1, line 12, strike "PHYSICIANS" and insert in lieu thereof "LICENSED HEALTH PRACTITIONERS".



2. On page 2, lines 2 and 3, strike the underscored language and insert in lieu thereof "three hundred twenty-three thousandths".



3. On page 3, line 18, strike the underscored language and insert in lieu thereof "and seventeen hundredths".



4. On page 4, strike Subsection B in its entirety and insert in lieu thereof:



"B. Receipts from the provision of medical and other health services provided by a licensed health practitioner within his scope of practice not otherwise deductible under the Gross Receipts and Compensating Tax Act may be deducted from gross receipts.".



5. On page 4, strike Paragraph (2) in its entirety and insert in lieu thereof:



"(2) "licensed health practitioner" means:



(a) a chiropractic physician licensed pursuant to the provisions of the Chiropractic Physician Practice Act;



(b) a dentist or dental hygienist licensed pursuant to the provisions of the Dental Health Care Act;



(c) a physician or physician assistant licensed pursuant to the provisions of Chapter 61, Article 6 NMSA 1978;



(d) an osteopathic physician licensed pursuant to the provisions of Chapter 61, Article 10 NMSA 1978 or an osteopathic physician's assistant licensed pursuant to the provisions of the Osteopathic Physicians' Assistants Act;



(e) a doctor of oriental medicine licensed pursuant to the provisions of the Acupuncture and Oriental Medicine Practice Act;



(f) a podiatrist licensed pursuant to the provisions of the Podiatry Act;



(g) an optometrist licensed pursuant to the provisions of the Optometry Act;



(h) a psychologist licensed pursuant to the provisions of the Professional Psychologist Act;



(i) a registered nurse or licensed practical nurse licensed pursuant to the provisions of the Nursing Practice Act;



(j) a registered lay midwife registered by the department of health;



(k) a physical therapist licensed pursuant to the provisions of the Physical Therapy Act;



(l) a registered occupational therapist licensed pursuant to the provisions of the Occupational Therapy Act; and



(m) a respiratory care practitioner licensed pursuant to the provisions of the Respiratory Care Act."".,
