SENATE FLOOR AMENDMENT number ___1___ to HOUSE BILL 8, as amended

Amendment sponsored by Senator Patrick H. Lyons

1. Strike Item 4 of House Floor Amendment 1.

2. On page 3, lines 2 and 3, strike "and on July 1 of fiscal year 2004".

3. On page 3, line 7, strike the ending quotation mark and between lines 7 and 8, insert the following new subsection:

"D. Beginning July 1, 2003, an annual distribution may be made from the tobacco settlement permanent fund to the tobacco settlement program fund in an amount that exceeds the distribution provided for in Subsection B of this section if the legislature, by a three-fifths' vote of the elected members in each house, votes in favor of increasing the distribution to the tobacco settlement program fund."".
