RELATING TO THE REDISTRICTING OF THE HOUSE OF REPRESENTATIVES; ESTABLISHING REPRESENTATIVE DISTRICTS; PROVIDING THE METHOD FOR ELECTING REPRESENTATIVES; PROVIDING FOR THE FILLING OF VACANCIES; FIXING THE NUMBER, RESIDENCE AND TERMS OF REPRESENTATIVES; REPEALING AND ENACTING SECTIONS OF THE NMSA 1978.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. SHORT TITLE.--This act may be cited as the "2001 House Redistricting Act".

Section 2. MEMBERSHIP.--The house of representatives is composed of seventy members to be elected from districts that are contiguous and that are as compact as is practical.

Section 3. RESIDENCE.--At the time of filing a declaration of candidacy for the office of state representative, a candidate shall reside in the district for which he files. Thereafter, if a representative permanently removes his residence from or maintains no residence in the district from which he was elected, he shall be deemed to have resigned and his successor shall be selected as provided in Section 4 of the 2001 House Redistricting Act.

Section 4. ELECTIONS--VACANCIES.--

A. Members of the house of representatives shall be elected for terms of two years.

B. If a vacancy occurs in the office of representative for any reason, the vacancy shall be filled as follows:

(1) for a representative district that is situated wholly within the exterior boundaries of a single county, the board of county commissioners of that county shall appoint the representative to fill the vacancy; and

(2) for a representative district situated within two or more counties:

(a) the board of county commissioners of each county in the representative district shall submit one name to the governor; and

(b) the governor shall appoint the representative to fill the vacancy from the list of names so submitted.

C. An appointment to fill a vacancy in the house of representatives shall be for a term ending on December 31 after the next general election.

D. An appointment to fill a vacancy made before the general election of 2002 shall be made from the district as it was described in Laws 1991 (1st S.S.), Chapter 2, Sections 8 through 77. After the general election of 2002, a vacancy shall be filled by appointment from the district set out in the 2001 House Redistricting Act.

Section 5. PRECINCTS.--

A. Precinct designations and boundaries used in the 2001 House Redistricting Act are those precinct designations and boundaries established pursuant to the Precinct Boundary Adjustment Act and revised and approved pursuant to that act by the secretary of state as of August 31, 2001.

B. A board of county commissioners shall not create any precinct that lies in more than one representative district and shall not divide any precinct so that the divided parts of the precinct are situated in two or more representative districts. Votes cast in a statewide election from precincts created or divided in violation of this subsection are invalid and shall not be counted or canvassed.

Section 6. DISTRICTS.--The districts of the house of representatives shall be as set out in Sections 7 through 76 of the 2001 House Redistricting Act.

Section 7. REPRESENTATIVE DISTRICT ONE.--Representative district one is composed of San Juan county precincts 12, 19 through 31, 51, 52, 57 and 58.

Section 8. REPRESENTATIVE DISTRICT TWO.--Representative district two is composed of San Juan county precincts 40 through 46, 49, 53 through 56, 59, 70 and 79.

Section 9. REPRESENTATIVE DISTRICT THREE.--Representative district three is composed of San Juan county precincts 47, 60 through 69 and 71 through 76.

Section 10. REPRESENTATIVE DISTRICT FOUR.--Representative district four is composed of San Juan county precincts 1 through 5, 7 through 11, 13 through 15, 18 and 81 through 83.

Section 11. REPRESENTATIVE DISTRICT FIVE.--Representative district five is composed of McKinley county precincts 3, 6, 19 through 22, 31 through 38, 40, 41, 47, 48 and 50.

Section 12. REPRESENTATIVE DISTRICT SIX.--Representative district six is composed of McKinley county precincts 16, 18, 23 through 30, 39, 42 through 46 and 49.

Section 13. REPRESENTATIVE DISTRICT SEVEN.--Representative district seven is composed of Valencia county precincts 4 through 6, 8 through 11, 14 through 16, 18, 28, 36 and 38.

Section 14. REPRESENTATIVE DISTRICT EIGHT.--Representative district eight is composed of Valencia county precincts 1 through 3, 7, 12, 17, 19, 21 through 27 and 37.

Section 15. REPRESENTATIVE DISTRICT NINE.--Representative district nine is composed of McKinley county precincts 1, 4, 5, 7 through 10, 12, 13 and 15; Rio Arriba county precincts 24 and 29; San Juan county precincts 6, 16 and 84 through 86; and Sandoval county precincts 24 and 26.

Section 16. REPRESENTATIVE DISTRICT TEN.--Representative district ten is composed of Bernalillo county precincts 90 through 92, 94 through 99, 101 through 103, 106, 107, 215, 223, 224, 241, 242 and 246.

Section 17. REPRESENTATIVE DISTRICT ELEVEN.--Representative district eleven is composed of Bernalillo county precincts 125, 131, 150 through 153, 161 through 165, 180, 181, 183 through 187, 195 through 197, 211, 212, 214, 217 and 221.

Section 18. REPRESENTATIVE DISTRICT TWELVE.--Representative district twelve is composed of Bernalillo county precincts 44, 49, 52, 54, 71, 73 through 77 and 88.

Section 19. REPRESENTATIVE DISTRICT THIRTEEN.--Representative district thirteen is composed of Bernalillo county precincts 32, 33, 35, 41 through 43, 45 through 48, 50, 51 and 53.

Section 20. REPRESENTATIVE DISTRICT FOURTEEN.--Representative district fourteen is composed of Bernalillo county precincts 36, 37, 61 through 67, 72, 104, 105, 121 through 124, 132, 133, 135, 154, 166, 225 and 226.

Section 21. REPRESENTATIVE DISTRICT FIFTEEN.--Representative district fifteen is composed of Bernalillo county precincts 3, 5, 6, 10, 86 and 422 through 425; and Sandoval county precincts 12, 13, 33 and 34.

Section 22. REPRESENTATIVE DISTRICT SIXTEEN.--Representative district sixteen is composed of Bernalillo county precincts 20 through 22, 24 through 26, 30, 81, 83 and 111 through 114.

Section 23. REPRESENTATIVE DISTRICT SEVENTEEN.--Representative district seventeen is composed of Bernalillo county precincts 4, 7 through 9, 11 through 18, 182, 191 through 194, 347 and 438.

Section 24. REPRESENTATIVE DISTRICT EIGHTEEN.--Representative district eighteen is composed of Bernalillo county precincts 23, 27 through 29, 34, 38 through 40, 55 and 120.

Section 25. REPRESENTATIVE DISTRICT NINETEEN.--Representative district nineteen is composed of Bernalillo county precincts 243 through 245, 251 through 256, 271 through 275, 281 through 285, 311, 312, 352, 353 and 381 through 384.

Section 26. REPRESENTATIVE DISTRICT TWENTY.--Representative district twenty is composed of Bernalillo county precincts 289 through 291, 293 through 301, 329 through 333, 552 and 554.

Section 27. REPRESENTATIVE DISTRICT TWENTY-ONE.--Representative district twenty-one is composed of Bernalillo county precincts 292, 318, 322, 461 through 465, 471 through 478, 502, 503, 505, 531, 533, 534 and 542.

Section 28. REPRESENTATIVE DISTRICT TWENTY-TWO.--Representative district twenty-two is composed of Bernalillo county precincts 302, 303, 551, 553, 555, 557 through 559 and 571; Santa Fe county precincts 15, 16, 73 and 84; and Torrance county precincts 3 through 5.

Section 29. REPRESENTATIVE DISTRICT TWENTY-THREE.--Representative district twenty-three is composed of Bernalillo county precincts 426, 427, 447, 449 through 452, 482, 483, 486, 538, 539, 541, 560, 563, 567, 568 and 602.

Section 30. REPRESENTATIVE DISTRICT TWENTY-FOUR.--Representative district twenty-four is composed of Bernalillo county precincts 453, 480, 484, 494 through 496, 504, 506 through 509, 511 through 518, 521, 523, 524, 528 and 565.

Section 31. REPRESENTATIVE DISTRICT TWENTY-FIVE.--Representative district twenty-five is composed of Bernalillo county precincts 216, 313, 341 through 346, 351, 354 through 358, 371, 372, 374, 375, 385 through 387, 431 through 434, 436, 437 and 442 through 444.

Section 32. REPRESENTATIVE DISTRICT TWENTY-SIX.--Representative district twenty-six is composed of Bernalillo county precincts 257, 258, 278, 286, 287, 314 through 317, 321, 323 and 326 through 328.

Section 33. REPRESENTATIVE DISTRICT TWENTY-SEVEN.--Representative district twenty-seven is composed of Bernalillo county precincts 407, 409, 410, 418 through 421, 440, 481, 485, 487 through 490, 499, 500, 510, 529 and 601.

Section 34. REPRESENTATIVE DISTRICT TWENTY-EIGHT.--Representative district twenty-eight is composed of Bernalillo county precincts 304 through 306, 308, 519, 525, 526, 530, 532, 535, 536, 540, 543 through 550 and 561.

Section 35. REPRESENTATIVE DISTRICT TWENTY-NINE.--Representative district twenty-nine is composed of Bernalillo county precincts 1, 2, 80, 82, 84, 85, 87 and 89.

Section 36. REPRESENTATIVE DISTRICT THIRTY.--Representative district thirty is composed of Bernalillo county precincts 373, 400 through 406, 408, 411 through 417, 435, 439, 441, 445, 446, 466, 491 through 493, 497 and 498.

Section 37. REPRESENTATIVE DISTRICT THIRTY-ONE.--Representative district thirty-one is composed of Bernalillo county precincts 307, 428 through 430, 454, 520, 522, 527, 537, 556, 562, 564, 566, 569 and 573; and Sandoval county precincts 1, 5, 6, 28, 55 and 56.

Section 38. REPRESENTATIVE DISTRICT THIRTY-TWO.--Representative district thirty-two is composed of Dona Ana county precincts 3 and 19; Hidalgo county precincts 1 through 3, 5 and 6; and Luna county precincts 2, 4, 6, 10, 11, 13 and 14.

Section 39. REPRESENTATIVE DISTRICT THIRTY-THREE.--Representative district thirty-three is composed of Dona Ana county precincts 13, 14, 16 through 18, 39, 40, 48, 82, 97 and 98.

Section 40. REPRESENTATIVE DISTRICT THIRTY-FOUR.--Representative district thirty-four is composed of Dona Ana county precincts 8 through 12, 15, 57, 79 through 81, 96 and 101.

Section 41. REPRESENTATIVE DISTRICT THIRTY-FIVE.--Representative district thirty-five is composed of Dona Ana county precincts 23, 25, 27 through 38, 41 through 44, 47, 49, 88, 90, 92 and 93.

Section 42. REPRESENTATIVE DISTRICT THIRTY-SIX.--Representative district thirty-six is composed of Dona Ana county precincts 1, 2, 4, 20 through 22, 24, 60, 63, 84 through 87, 89, 95, 99 and 100.

Section 43. REPRESENTATIVE DISTRICT THIRTY-SEVEN.--Representative district thirty-seven is composed of Dona Ana county precincts 26, 45, 46, 61, 62, 66 through 70, 83, 91, 94, 102 and 103.

Section 44. REPRESENTATIVE DISTRICT THIRTY-EIGHT.--Representative district thirty-eight is composed of Grant county precincts 1 through 7, 10 through 15, 17, 30 and 31; Hidalgo county precinct 4; and Sierra county precincts 1 and 3 through 9.

Section 45. REPRESENTATIVE DISTRICT THIRTY-NINE.--Representative district thirty-nine is composed of Grant county precincts 8, 9, 16, 18 through 29 and 32 through 34; and Luna county precincts 1, 5, 7 through 9 and 12.

Section 46. REPRESENTATIVE DISTRICT FORTY.--Representative district forty is composed of Mora county precincts 2, 4 and 5; Rio Arriba county precincts 2, 5, 6, 16, 17, 38 and 41; San Miguel county precincts 9, 23 and 24; Santa Fe county precincts 9, 13, 48, 55, 57, 68 and 69; and Taos county precincts 28, 31 and 32.

Section 47. REPRESENTATIVE DISTRICT FORTY-ONE.--Representative district forty-one is composed of Rio Arriba county precincts 1, 7 through 12, 18 through 20, 22, 23, 25 through 27, 30 through 37 and 39; Sandoval county precincts 21 through 23; and Santa Fe county precincts 5, 40 and 59.

Section 48. REPRESENTATIVE DISTRICT FORTY-TWO.--Representative district forty-two is composed of Taos county precincts 1, 2, 5, 6, 8 through 27, 29, 30, 34 and 35.

Section 49. REPRESENTATIVE DISTRICT FORTY-THREE.--Representative district forty-three is composed of Los Alamos county; Sandoval county precincts 7, 10, 16 through 18 and 51; and Santa Fe county precincts 6, 12, 82 and 83.

Section 50. REPRESENTATIVE DISTRICT FORTY-FOUR.--Representative district forty-four is composed of Sandoval county precincts 11, 35 through 39, 50, 53, 54 and 58 through 64.

Section 51. REPRESENTATIVE DISTRICT FORTY-FIVE.--Representative district forty-five is composed of Santa Fe county precincts 29, 31, 32, 34, 35, 38, 39, 42, 49 through 51, 66, 67, 74, 76 and 78.

Section 52. REPRESENTATIVE DISTRICT FORTY-SIX.--Representative district forty-six is composed of Rio Arriba county precincts 3, 4, 13 through 15 and 40; and Santa Fe county precincts 1 through 4, 7, 8, 10, 23, 28, 30, 58, 60, 61 and 79.

Section 53. REPRESENTATIVE DISTRICT FORTY-SEVEN.--Representative district forty-seven is composed of Santa Fe county precincts 14, 37, 41, 43, 52 through 54, 56, 62, 70, 75, 77 and 81.

Section 54. REPRESENTATIVE DISTRICT FORTY-EIGHT.--Representative district forty-eight is composed of Santa Fe county precincts 11, 20 through 22, 24 through 27, 33, 36, 44 through 47, 64, 80 and 86.

Section 55. REPRESENTATIVE DISTRICT FORTY-NINE.--Representative district forty-nine is composed of Catron county; Sierra county precinct 2; Socorro county precincts 1 through 14, 16 and 17; and Valencia county precincts 20, 31 and 35.

Section 56. REPRESENTATIVE DISTRICT FIFTY.--Representative district fifty is composed of San Miguel county precincts 18 and 20; Santa Fe county precincts 18, 19 and 85; Torrance county precincts 1, 2 and 6 through 13; and Valencia county precincts 29, 30 and 32 through 34.

Section 57. REPRESENTATIVE DISTRICT FIFTY-ONE.--Representative district fifty-one is composed of Otero county precincts 15, 19, 21 through 28, 30 through 33, 37 and 39.

Section 58. REPRESENTATIVE DISTRICT FIFTY-TWO.--Representative district fifty-two is composed of Dona Ana county precincts 6, 7, 50 through 56, 58, 71 through 74, 77, 78 and 104.

Section 59. REPRESENTATIVE DISTRICT FIFTY-THREE.--Representative district fifty-three is composed of Dona Ana county precincts 5, 59, 64 and 65; and Otero county precincts 16 through 18, 20 and 34 through 36.

Section 60. REPRESENTATIVE DISTRICT FIFTY-FOUR.--Representative district fifty-four is composed of Dona Ana county precincts 75 and 76; Eddy county precincts 10, 11, 13 through 15, 29, 30, 34 and 35; and Otero county precincts 1 through 9 and 40.

Section 61. REPRESENTATIVE DISTRICT FIFTY-FIVE.--Representative district fifty-five is composed of Eddy county precincts 4 through 8, 12, 16 through 18, 20, 21, 23, 25 through 28, 37 through 40 and 45.

Section 62. REPRESENTATIVE DISTRICT FIFTY-SIX.--Representative district fifty-six is composed of Lincoln county precincts 6 through 11; and Otero county precincts 10 through 14, 29 and 38.

Section 63. REPRESENTATIVE DISTRICT FIFTY-SEVEN.--Representative district fifty-seven is composed of Chaves county precincts 2 through 7, 9 through 14, 16 and 41; Eddy county precincts 1 through 3, 42 and 43; and Lincoln county precincts 1 and 3.

Section 64. REPRESENTATIVE DISTRICT FIFTY-EIGHT.--Representative district fifty-eight is composed of Chaves county precincts 15, 42, 43, 51, 52, 61 through 63, 71 through 73, 90, 92 and 101 through 103; and Eddy county precinct 41.

Section 65. REPRESENTATIVE DISTRICT FIFTY-NINE.--Representative district fifty-nine is composed of Chaves county precincts 21 through 25, 31 through 36, 81 through 85, 91, 93 and 104; and Lincoln county precincts 2, 4, 5, 12 and 13.

Section 66. REPRESENTATIVE DISTRICT SIXTY.--Representative district sixty is composed of Sandoval county precincts 30 through 32, 40 through 49 and 67.

Section 67. REPRESENTATIVE DISTRICT SIXTY-ONE.--Representative district sixty-one is composed of Eddy county precincts 9, 19, 31 through 33, 36 and 44; and Lea county precincts 36, 52 through 55, 61, 62 and 71 through 74.

Section 68. REPRESENTATIVE DISTRICT SIXTY-TWO.--Representative district sixty-two is composed of Lea county precincts 18, 20, 22 through 25, 27 through 35, 41 through 44 and 51.

Section 69. REPRESENTATIVE DISTRICT SIXTY-THREE.--Representative district sixty-three is composed of Curry county precincts 5 through 9, 20 through 22, 25 through 30 and 36; and Roosevelt county precincts 1, 7, 8 and 17.

Section 70. REPRESENTATIVE DISTRICT SIXTY-FOUR.--Representative district sixty-four is composed of Curry county precincts 2, 10 through 15, 17 through 19, 23, 24, 32, 33, 35 and 37; and Roosevelt county precincts 2, 11, 12 and 18.

Section 71. REPRESENTATIVE DISTRICT SIXTY-FIVE.--Representative district sixty-five is composed of Bernalillo county precincts 31 and 93; Cibola county precincts 1 through 3; Sandoval county precincts 2 through 4, 8, 9, 14, 15, 19, 20, 27 and 29; Socorro county precinct 15; and Valencia county precinct 13.

Section 72. REPRESENTATIVE DISTRICT SIXTY-SIX.--Representative district sixty-six is composed of Chaves county precinct 1; Lea county precincts 2, 3, 10 through 17, 21 and 26; and Roosevelt county precincts 3 through 5, 9, 10 and 13 through 16.

Section 73. REPRESENTATIVE DISTRICT SIXTY-SEVEN.--Representative district sixty-seven is composed of Colfax county; Harding county; Mora county precincts 1, 3 and 6 through 11; Quay county precinct 4; San Miguel county precinct 15; Taos county precincts 3, 4, 7 and 33; and Union county.

Section 74. REPRESENTATIVE DISTRICT SIXTY-EIGHT.--Representative district sixty-eight is composed of Curry county precincts 1, 3, 4, 16, 31 and 34; De Baca county; Guadalupe county; Quay county precincts 1 through 3 and 5 through 13; Roosevelt county precinct 6; and San Miguel county precincts 1, 6, 7, 10, 14 and 17.

Section 75. REPRESENTATIVE DISTRICT SIXTY-NINE.--Representative district sixty-nine is composed of Cibola county precincts 4 through 17; McKinley county precincts 11, 14 and 17; and Sandoval county precinct 25.

Section 76. REPRESENTATIVE DISTRICT SEVENTY.--Representative district seventy is composed of San Miguel county precincts 2 through 5, 8, 11 through 13, 16, 19, 21, 22 and 25 through 28; and Santa Fe county precincts 17, 63, 65, 71 and 72.

Section 77. ELECTION OF REPRESENTATIVES.--Representatives shall be elected from the districts described in the 2001 House Redistricting Act at the 2002 and subsequent general elections.

Section 78. REPEAL.--Sections 2-7C-1 through 2-7C-78 NMSA 1978 (being Laws 1991 (1st S.S.), Chapter 2, Sections 1 through 78) are repealed.
