A JOINT RESOLUTION

RATIFYING CONDITIONS OF SALE OF LA VILLA RIVERA AND MARIAN HALL IN SANTA FE IN SANTA FE COUNTY.



WHEREAS, Laws 1998, Senate Joint Resolution 13, authorized the property control division of the general services department to sell La Villa Rivera, Marian hall and Cathedral park in Santa Fe county; and

WHEREAS, Cathedral park was sold to the city of Santa Fe for use as a park in 1999; and

WHEREAS, pursuant to Laws 1998, Senate Joint Resolution 13, the property control division of the general services department obtained an appraisal of the value of La Villa Rivera and Marian hall, issued an invitation to bid and selected the highest bidder; and

WHEREAS, the highest bidder offered a purchase price of ten million one hundred thousand dollars ($10,100,000) for La Villa Rivera and Marian hall, which was higher than the appraised value of eight million dollars ($8,000,000);

NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the sale of La Villa Rivera and Marian hall be hereby ratified as follows, any term and condition in the invitation to bid and bid notwithstanding, that:

A. the full purchase price of ten million one hundred thousand dollars ($10,100,000) be paid by certified check by the highest bidder at the beginning of the closing process on March 27, 2001;

B. the proceeds of the sale be held in a suspense account pending finalization of the sale, with interest accruing to the property control reserve fund pursuant to Section 15-3-24.2 NMSA 1978;

C. finalization of the sale be by quitclaim deed and be contingent on issuance by the construction industries division of the regulation and licensing department to the buyer of all applicable building permits and certificate of occupancy;

D. the construction industries division of the regulation and licensing department issue building permits and certificate of occupancy only after it reviews and approves building improvements that are consistent with the historic character of the area, in the public interest, and that maximize mixed use of the property that promotes economic development;

E. in the interim period between the payment of the purchase price to the state by the buyer and finalization of the sale, the property control division of the general services department lease La Villa Rivera and Marian hall to the buyer;

F. the lease between the property control division of the general services department and the buyer include provisions for the buyer to assume any existing leases with tenants of the property that are not state agencies, and accommodating any state agency tenants, pursuant to the terms and conditions of the most recent invitation to bid, to ensure minimal disruption of the tenants' operations and programs; and

G. the buyer be responsible for all improvements proposed and completed during the interim period, which shall not exceed two years; and

BE IT FURTHER RESOLVED that copies of this resolution be transmitted to the property control division of the general services department, the construction industries division of the regulation and licensing department and the city of Santa Fe.
