REQUESTING THE PUBLIC REGULATION COMMISSION TO CONDUCT A STUDY OF THE POSSIBLE LACK OF EQUITY IN THE NUMBER OF MEMBERS THAT AN ELECTRIC COOPERATIVE'S BOARD OF TRUSTEE MEMBER MAY REPRESENT AND TO MAKE RECOMMENDATIONS, IF NECESSARY, REGARDING POSSIBLE MEASURES THAT MAY BE TAKEN TO ATTAIN EQUITY.
WHEREAS, in New Mexico there exist cooperative nonprofit membership corporations, organized pursuant to the Rural Electric Cooperative Act, that supply electric power and energy and promote and extend the use of electricity in rural areas; and
WHEREAS, the business and affairs of an electric cooperative are managed by a board of trustees; and
WHEREAS, electric cooperatives' bylaws prescribe the number of board of trustee members, the terms of the board of trustee members and the manner of their election; their qualifications; and the election of successors to board of trustee members who resign, die or otherwise are incapable of acting; and
WHEREAS, in some rural districts, there exists a lack of equity in the number of members that an electric cooperative board of trustee member may represent;
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the public regulation commission be requested to study the possible lack of equity in the number of members that an electric cooperative board of trustee member represents and to make recommendations, if necessary, regarding possible measures that may be taken to attain equity; and
BE IT FURTHER RESOLVED that the public regulation commission present the results of its study to the appropriate legislative interim committee prior to November 2001; and
BE IT FURTHER RESOLVED that copies of this memorial be transmitted to the members of the public regulation commission.
