Mr. President:

Your CONSERVATION COMMITTEE, to whom has been referred

SENATE BILL 855

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

1. On page 2, line 1, strike "if the", strike line 2, strike line 3 through "are" and insert in lieu thereof "when".

2. On page 2, line 3, after "bonds" insert "are" and on line 4, after "1978" insert "to construct and install a new municipal wastewater utility in an area that is without public or private wastewater utility service".

3. On page 4, line 10, strike the semicolon and the remainder of the line, strike lines 11 through 13 and insert in lieu thereof:

"and shall not apply when gross receipts tax revenue bonds are issued by a municipality pursuant to Sections 3-31-1 through 3-31-12 NMSA 1978 to construct and install a new municipal wastewater utility in an area that is without public or private wastewater utility service."".
