SENATE FLOOR AMENDMENT number _1____ to SENATE BILL 148, as amended

Amendment sponsored by Senator Shannon Robinson

1. On page 2, between lines 5 and 6, insert the following subsection:

"B. "category and caliber" means whether a handgun is semiautomatic or not semiautomatic and the caliber of a handgun;".

2. Reletter the succeeding subsections accordingly.

3. On page 2, strike lines 11 and 12 and insert in lieu thereof the following subsection:

"E. "handgun" means a firearm that will, is designed to or may be readily converted to expel a projectile by the action of an explosion and the barrel length of which, not including a revolving, detachable or magazine breech, does not exceed twelve inches; and".

4. On page 2, line 16, strike "July 1, 2001" and insert in lieu thereof "January 1, 2002".

5. On page 3, line 22, after "department" insert "for the category and caliber of handguns that the applicant wants to be licensed to carry as concealed handguns".

6. On page 4, line 11, strike "Applications" and insert in lieu thereof "Effective July 1, 2001, applications".

7. On page 5, line 4, strike "may" and insert in lieu thereof "shall".

8. On page 5, line 12, strike "fifty dollars ($50.00)" and insert in lieu thereof "seventy-five dollars ($75.00)".

"(4) a description of the category and caliber of concealed handguns that the licensee is licensed to carry.".

22. On page 9, strike lines 19 through 25 in their entirety, on page 10, strike lines 1 through 8 in their entirety, and insert in lieu thereof the following subsection:

"G. A licensee may renew his concealed handgun license by submitting to the department a renewal form, completed under oath, designed and provided by the department, accompanied by a payment of a fifty-dollar ($50.00) renewal fee. A licensee who renews his concealed handgun license may renew his license by taking a refresher firearms training course and paying the fifty-dollar ($50.00) renewal fee to the department. The refresher firearms training course shall allow a licensee the opportunity to demonstrate his ability to safely use handguns of different category and caliber than those for which he was previously licensed. A concealed handgun license shall not be renewed more than sixty days after it has expired. A licensee who fails to renew his concealed handgun license within sixty days after it has expired may apply for a new concealed handgun license pursuant to the provisions of the Personal Protection Act.".

23. On page 10, line 9, strike "may" and insert in lieu thereof "shall".

24. On page 10, line 12, after "application" insert "form or renewal form".

25. On page 10, line 25, after the period insert "A firearms training course shall include classroom instruction and range instruction and an actual demonstration by the applicant of his ability to safely use a handgun. The course shall provide an applicant the opportunity to demonstrate his ability to safely use handguns of different category and caliber for which he seeks to be licensed to carry. An applicant shall not be licensed unless he demonstrates, at a minimum, the ability to use a handgun of .32 caliber.".

26. On page 14, line 15, after "fund" insert "and may be used to maintain the state's criminal history database".
