Your JUDICIARY COMMITTEE, to whom has been referred

HOUSE GOVERNMENT AND URBAN AFFAIRS COMMITTEE

SUBSTITUTE FOR HOUSE BILL 322

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

1. On page 4, between lines 16 and 17, insert the following new section:

"Section 4. A new section of Chapter 3, Article 44 NMSA 1978 is enacted to read:

"[NEW MATERIAL] HOSPITALS--EXPENDITURE OF PUBLIC FUNDS.--The use of public funds for the operation and maintenance of a hospital pursuant to a lease authorized by Chapter 3, Article 44 NMSA 1978 is deemed to be funding to the hospital as a public institution, and the hospital facility and lessee thereof are subject to the laws of this state regarding the expenditure of public money."".

2. Renumber the succeeding sections accordingly.
