RELATING TO LAW ENFORCEMENT; CREATING THE LAW ENFORCEMENT
TELECOMMUNICATIONS FUND; MAKING AN APPROPRIATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. FUND CREATED--ADMINISTRATION OF THE FUND.--
A. The "law enforcement telecommunications fund" is created in the state treasury. Money in the fund is appropriated to the department of public safety for the sole purpose of meeting necessary expenses incurred in the operation and maintenance of the law enforcement telecommunications system.
B. The law enforcement telecommunications fund shall be administered by the department of public safety. Expenditures from the fund shall be made pursuant to budgets approved by the state budget division of the department of finance and administration. Money in the fund shall be expended upon warrants drawn by the secretary of finance and administration on vouchers signed by the secretary of public safety or his authorized representative.
C. The department of public safety shall authorize additional users of the law enforcement telecommunications system. The department shall request an appropriation each fiscal year that is based upon the department's expenses incurred in operating and maintaining the law enforcement telecommunications system.
Section 2. APPROPRIATION.--Seven hundred thousand dollars ($700,000) is appropriated from the general fund to the law enforcement telecommunications fund for expenditure in fiscal year 2002 for expenses incurred by the department of public safety in operating and maintaining the law enforcement telecommunications system. Any unexpended or unencumbered balance remaining at the end of fiscal year 2002 shall revert to the general fund.
Section 3. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2001.
