HOUSE EXECUTIVE MESSAGE NO. 62

The Honorable Ben Lujan and

Members of the House of Representatives

Executive-Legislative Building

Santa Fe, New Mexico 87503

Honorable Speaker and Members of the House:

I have this day VETOED and am returning HOUSE BILL 111, as amended

enacted by the Forty-Fifth Legislature, First Session, 2001.

This bill would enact the Uniform Trust Code into New Mexico law.  While I am generally supportive of uniform laws as a means to provide certainty in the courts, I am troubled that New Mexico would become one of the only states to enact these new uniform provisions.  I am also concerned by the fact that this law would apply retroactively to trusts already in existence. If  I were to sign this bill, our state would be forced to work out the open legal questions presented by the Uniform Trust Code, leading to increased litigation in our courts and greater legal expenses for our citizens.

Sincerely,

          Gary E. Johnson

Governor
