Synopsis of Bill



Senate Floor Substitute for Senate Joint Memorial 40 requests that the State Department of Public Education require the Superintendent of the Albuquerque Public Schools (APS) and his staff meet with those affected by the Sambrano Agreement to review evidence of the district's adherence to the agreement, assess progress to date, and, using information gleaned from a national review of literature and models, develop a revised plan for overcoming the deficiencies addressed by the original agreement.



The Senate Floor Substitute for Senate Joint Memorial 40 directs that the APS Superintendent and the Sambrano Monitoring Committee present the new agreement to the APS Board of Education, the State Board of Education (SBE) and the Rio Grande Community by December 15, 2000.



Significant Issues



A question which may arise and must be considered is whether the SDE has the authority to direct that APS meet with the Sambrano Monitoring Committee and carry out the directives in the memorial.



Using the broad powers of the SBE and the SDE, the SDE can probably order that the meeting be held. However, APS may have grounds for to challenge the legality of the order from the SDE.
