SUMMARY



Synopsis of Bill



Senate Bill 390 amends the duties of the State Board of Education (SBE) (Section 22-2-2 NMSA 1978) by including responsibility for determining the policy for operation of vocational programs for the juvenile construction industries programs now within the purview of the Children, Youth and Families Department (CYFD).



Significant Issues



The SBE's responsibility for all education programs is derived from the state constitution, Article XII, Section 6, and Section 22-14-2 NMSA 1978. While the basic authority of the SBE is constitutionally based, state statutes provide the operational framework.



Historically, SDE staff has provided technical assistance to vocational programs within the youth corrections system, and, upon request, has reviewed them for accreditation. The provisions of the bill place these programs within the policies of the SBE and the regulatory framework of the SDE, especially for accreditation purposes.



FISCAL IMPLICATIONS



None.

ADMINISTRATIVE IMPLICATIONS



None. SDE staff already provides guidance and technical assistance for these programs.
