SUMMARY
Synopsis of Senate Finance Committee Amendment
The Senate Finance Committee (SFC) amendment to Senate Bill 366 makes two changes. First, it appropriates $4.0 million from the Game Protection Fund, and eliminates any general fund appropriation. Second, it replaces the Property Control Division of the General Services Department with the Department of Game and Fish as the lead agency in the purchase of Eagle Nest Lake. The State Game Commission does have the authority to purchase and own lands for hunting and fishing pursuant to Chapter 17, NMSA 1978.
Synopsis of Bill
Senate Bill 366 appropriates $2,000.0 from the Game Protection Fund and $2,000.0 from the general fund to begin acquiring Eagle Nest Lake and the surrounding area. The appropriation would be made to the property control division of the General Services Department (GSD). The GSD may propose land for trade as part of the purchase agreement. The GSD shall report on the progress of the acquisition by December 1, 2000. The bill contains a clause that requires the GSD to revert any unexpended balance as of FY09 to the general fund.
Significant Issues
The Department of Game and Fish (DGF) carries a $22 million cash balance in the Game Protection Fund. The State Game Commission approved expenditure of $2 million for the purchase of Eagle Nest Lake. Additional cash balance may be available for this important land acquisition.
According to the DGF, the preliminary purchase agreement is about $22 million, to be purchased over 8 years. This would allow the DGF to re-enter into a lease agreement until the final purchase agreement is completed.
