SUMMARY



Synopsis of Bill



Senate Bill 365 amends Section 66-5-68 NMSA 1978, the New Mexico Commercial Driver's License Act. The bill would disqualify a person from driving a commercial vehicle for a period of not less than one year if the person driving the vehicle is under the influence of intoxicating liquor or drugs.

The Motor Vehicle Division would disqualify a person from driving a commercial vehicle for at least 180 days and not more than two years for the first violation of an out-of-service order while driving hazardous materials or operating a vehicle designed to carry more than 15 people (including the driver). Subsequent violations would result in disqualifications of at least three years but not more than five years.



Senate Bill 365 requires that persons convicted of out-of-service order violations must pay a fine of $1.0 to $2.5. If the violator is an employer, the fine is $2.5 to $10.0.
