Synopsis of Bill



Senate Bill 328 enacts the Uniform Correction or Clarification of Defamation Act. The Act requires a party to make a request for a correction or a clarification of an allegedly defamatory statement before being allowed to sue for defamation. If corrections or clarifications are made pursuant to the requirements set forth in the Act, then the requestor is limited to recovering only economic losses as a result of the statement.

Significant Issues



Senate Bill 328 adds a new step to the process of suing for defamation and could potentially limit the amount of money a requestor could recover in certain defamation cases.
