SUMMARY
Synopsis of Bill
Senate Bill 110 enacts a section of the Criminal Code which authorizes a peace officer to arrest and take into custody a person whom the peace officer has probable cause to believe has permitted a misdemeanor offense on school premises. The bill also provides that the peace officer shall not be held criminally or civilly liable for making the arrest provided that the officer acts in good faith.
Significant Issues
According to the State Department of Education, consideration should be given to incorporating provisions in the bill requiring verification of the identity of the peace officer making the arrest in order to prevent persons impersonating officers from taking students from school premises.
