SUMMARY
Synopsis of Bill
House Bill 270 authorizes the New Mexico Environment Department (NMED) to develop and administer a pollution prevention program. In developing and administering the program, NMED may enter into contracts with the federal government and develop rules as needed. Records, reports or information obtained by NMED pursuant to the program shall be public, unless the person furnishing the information request that they remain confidential in order to protect trade secrets. The secretary of NMED shall promulgate a rule to ensure confidentiality in such cases.
Significant Issues
Violation of confidentiality under the rules authorized in this bill is a misdemeanor.
